Terms of Service

These Terms of Service ("Terms") govern the use of the vehicle rental services provided by DriveNow Car Rental ("DriveNow", "we", "us", "our"), located at Calle de Alcalá, 50, 28014 Madrid, España. By renting a vehicle from us or submitting an enquiry through our website, you ("Customer", "you") agree to be bound by these Terms.

Please read these Terms carefully before using our services.

1. Eligibility and Driver Requirements

• The primary renter must be at least 21 years of age. Drivers aged 21–24 may be subject to a young driver surcharge.
• A valid driving licence held for a minimum of 1 year is required.
• A valid passport or national identity document must be presented at the time of pickup.
• A credit or debit card in the primary renter's name is required for the security deposit.

2. Booking and Payment

• Bookings may be made online, by phone, or in person at our office.
• Full payment or a deposit may be required at the time of booking to secure a vehicle.
• All prices are quoted in Euros (€) and include applicable Spanish taxes (IVA) unless stated otherwise.
• The balance is due at the time of vehicle pickup.
• We accept major credit cards, debit cards, and bank transfers for business accounts.

3. Cancellation and Refund Policy

• Cancellations made more than 48 hours before the scheduled pickup receive a full refund.
• Cancellations made within 24–48 hours of pickup receive a 50% refund.
• Cancellations made less than 24 hours before pickup are non-refundable.
• No-shows are non-refundable.
• Refunds are processed within 5–10 business days.

4. Vehicle Use

The rented vehicle may only be used by the authorised driver(s) listed in the rental agreement. Use of the vehicle is restricted to mainland Spain and the Balearic Islands unless written permission is granted in advance. The following uses are strictly prohibited:

• Transporting passengers or goods for hire or reward.
• Participation in motor racing, rallying, or off-road driving.
• Driving under the influence of alcohol, drugs, or any impairing substance.
• Smoking inside the vehicle.
• Transporting animals without prior written consent.
• Use contrary to any applicable law or regulation.

5. Insurance and Liability

• Basic third-party liability insurance is included in all rentals.
• An optional Collision Damage Waiver (CDW) is available to reduce your excess liability.
• The customer is liable for all damage to the vehicle not covered by the selected insurance package up to the stated excess amount.
• The customer is fully liable for damage caused by negligence, wilful misconduct, or breach of these Terms.
• DriveNow is not liable for loss of or damage to personal belongings left in the vehicle.

6. Fuel Policy

Vehicles are provided with a full tank of fuel and must be returned with a full tank. Failure to return the vehicle with a full tank will result in a refuelling charge plus an applicable service fee.

7. Returns and Late Returns

• The vehicle must be returned to the agreed location and time specified in the rental agreement.
• Late returns may be charged at an additional daily rate.
• If you wish to extend your rental, you must contact us at least 24 hours before the scheduled return.

8. Traffic Violations and Fines

The customer is fully responsible for any traffic fines, tolls, or parking charges incurred during the rental period. An administration fee may be applied by DriveNow for processing fines on your behalf.

9. Limitation of Liability

To the maximum extent permitted by Spanish law, DriveNow shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services or vehicles.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.

11. Changes to These Terms

We reserve the right to update or modify these Terms at any time. The most current version will always be posted on this page. Continued use of our services after any changes constitutes acceptance of the revised Terms.
